3.4 Age and Parent/Guardian Declaration

PK Canine Online Learning requires a registration declaration.

A person registering through the online learning platform must select one of the following:

I am aged 18 or over and registering independently.

or

I am a parent or legal guardian registering on behalf of a learner under 18.

The default registration option cannot be used to complete registration.

We record the declaration selected where necessary to administer the registration process and demonstrate the registration arrangement in place.

Where a learner is under 18, registration and course purchases must be arranged by a parent or legal guardian.

This is a PK Canine service requirement designed to provide appropriate oversight for younger learners.

It does not remove a child or young person's own rights under data protection law.

3.5 Parent and guardian information

Where a parent or legal guardian is arranging access for a learner under 18, we may process:

  • parent or guardian name;
  • contact details;
  • registration declaration;
  • account administration information;
  • purchase information;
  • communications with PK Canine;
  • information concerning parental or guardian authority where reasonably necessary; and

We will only request additional evidence of parental or guardian authority where reasonably necessary.

  • your name;
  • email address;
  • telephone number;
  • the contents of your message;
  • enquiry history;
  • correspondence; and

3.7 HubSpot and free resources

PK Canine uses HubSpot for customer relationship management, forms, enquiries and certain email communications.

Where you complete a HubSpot form, including a form requesting a free resource, we may collect:

  • first name;
  • last name;
  • email address;
  • form submission information;
  • the resource requested;
  • date and time of submission;
  • marketing preference;
  • consent information;
  • communication history; and
  • technical information associated with the submission.

Requesting a free resource does not require you to subscribe to PK Canine marketing.

Where a form contains an optional marketing checkbox, you may receive the requested resource whether or not you choose to subscribe to marketing.

3.8 Marketing information

Where you choose to receive marketing, we may record:

  • your email address;
  • the date and method of consent;
  • the wording you consented to;
  • marketing preferences;
  • unsubscribe requests;
  • email delivery information;
  • email engagement information, such as opens or clicks, where enabled; and
  • records necessary to demonstrate or honour your marketing preferences.

3.9 Payment and transaction information

Where you purchase a service or course, we may process:

  • name;
  • contact information;
  • amount paid;
  • product or service purchased;
  • transaction reference;
  • payment status;
  • invoice information; and
  • accounting records.

Where payments are processed through Stripe, PK Canine does not normally receive or store your complete payment card details.

  • record course progress;
  • administer quizzes and assessments;
  • determine course completion;
  • issue and verify certificates;
  • process payments;
  • provide customer and learner support;
  • deliver requested free resources;
  • manage HubSpot CRM records;

  • protect our systems and users;
  • investigate suspected misuse or fraud;
  • improve our services;
  • administer complaints;
  • establish, exercise or defend legal claims; and
  • meet legal, tax, accounting, insurance or regulatory requirements.

5. Our Lawful Bases for Processing

Under UK data protection law, we must have a lawful basis for processing personal information.

The lawful basis depends on why the information is being used.

5.1 Contract

We may process personal information where necessary to:

  • provide a service you have requested;
  • administer a booking;
  • provide a purchased course;
  • manage an online learning account;
  • process an order or payment;
  • provide learner access; or
  • perform our contractual obligations.

5.2 Legitimate Interests

We may rely on legitimate interests where reasonably necessary to:

  • operate PK Canine;
  • respond to enquiries;
  • maintain client relationships;
  • provide customer support;
  • administer our learning platform;
  • maintain appropriate training and learning records;
  • improve our services;
  • prevent fraud and misuse;
  • protect our website and systems;
  • manage complaints and disputes;
  • maintain appropriate business records; and
  • understand how our services are being used.

Where we rely on legitimate interests, we consider whether our interests are outweighed by the individual's rights and interests.

5.3 Consent

We may rely on consent where you have actively agreed to an optional activity, including certain marketing communications.

Where processing is based on consent, you may withdraw that consent at any time.

Withdrawal does not affect processing that was lawful before consent was withdrawn.

5.4 Legal Obligation

We may process or retain information where necessary to meet:

  • tax requirements;
  • accounting requirements;
  • regulatory obligations;
  • court orders;
  • lawful requests from authorities; or
  • other legal responsibilities.

5.5 Legal claims

Where appropriate, information may also be processed where necessary to establish, exercise or defend legal claims.

6. Children and Young People

PK Canine Online Learning is primarily designed for adults but may be used by younger learners where appropriate arrangements are in place.

Our registration arrangements are:

Learners aged 18 or over

They may register and purchase courses independently.

Learners under 18

Registration and course purchases must be arranged by a parent or legal guardian.

The registering adult must select the declaration confirming that they are:

a parent or legal guardian registering on behalf of a learner under 18.

A learner under 18 must not use the adult declaration to bypass this requirement.

Parents and guardians are responsible for determining whether course content and practical activities are appropriate for the learner and for providing appropriate supervision.

Where consent is the lawful basis for processing personal information relating to a child or young person, we will consider whether parental authorisation is legally required and take reasonable steps where appropriate.

UK law contains specific requirements where consent is relied upon for certain online services offered directly to children under 13.

PK Canine's requirement for parent or guardian involvement for all learners under 18 is a separate service safeguard and is more restrictive than this specific age threshold.

Parents and guardians should be aware that young people retain their own data protection rights.

We will consider the learner's age, understanding and circumstances when handling requests relating to their personal information.

7. Parent and Guardian Responsibilities

Where an adult registers on behalf of a learner under 18, they confirm that they are the learner's parent or legal guardian or otherwise hold appropriate legal authority.

The responsible adult should:

  • provide accurate information;
  • arrange and authorise purchases;
  • review course suitability;
  • provide appropriate supervision;
  • ensure practical activities are suitable;
  • assist the learner in following course safety guidance; and
  • contact PK Canine where support is required.

PK Canine may contact the responsible adult where necessary to administer the account, resolve an issue, address a safety concern or respond to an appropriate privacy enquiry.

8. Moodle and Online Learning

PK Canine Online Learning is operated using Moodle.

Our Moodle platform is hosted using infrastructure provided by Hetzner.

Personal information processed through Moodle may include:

  • account information;
  • course enrolment;
  • course progress;
  • assessments;
  • results;
  • completion information;
  • certificates;
  • login history;
  • IP information;
  • technical logs;
  • communications; and
  • registration declarations.

PK Canine remains responsible for determining how personal information is used within our online learning environment.

9. Course Progress, Assessments and Certificates

PK Canine may maintain records of:

  • courses enrolled on;
  • modules completed;
  • knowledge checks;
  • assessment attempts;
  • scores;
  • pass or fail results;
  • completion dates; and
  • certificates issued.

These records may be used to:

  • administer learning;
  • provide learner support;
  • determine successful completion;
  • issue certificates;
  • verify certificates; and
  • maintain appropriate professional training records.

10. HubSpot

PK Canine uses HubSpot for purposes which may include:

  • CRM;
  • enquiry management;
  • contact management;
  • online forms;
  • lead magnets and free resources;
  • email delivery;
  • marketing preference management;
  • marketing communications;
  • communication history; and
  • workflow automation.

Information submitted through a HubSpot form may be stored within our HubSpot account.

Where you request a free guide or similar resource, we may use the information you provide to:

  • identify you;
  • send the requested resource;
  • record that it was requested;
  • manage the request;
  • prevent duplicate or abusive submissions; and
  • provide related customer support.

Receiving a requested free resource is separate from consenting to ongoing marketing.

11. Marketing and Email Communications

PK Canine may send marketing communications about:

  • dog training;
  • behaviour services;
  • online courses;
  • free resources;
  • educational information;
  • course updates;
  • events;
  • promotions; and
  • special offers.

Where consent is required, we will seek a clear positive opt-in.

Marketing consent will not be bundled into:

  • Moodle registration;
  • a course purchase;
  • access to a free resource; or
  • acceptance of our Terms and Conditions.

We do not use pre-ticked marketing boxes.

Where permitted by law, we may rely on the existing-customer or products-and-services soft opt-in for marketing our own similar products or services, but only where the legal requirements are met.

Every electronic marketing communication will provide an appropriate way to unsubscribe or object.

You may unsubscribe at any time.

We may retain limited suppression information after you unsubscribe so that we can remember and respect your preference not to receive further marketing.

12. Free Resources and Lead Magnets

PK Canine may provide free educational resources in exchange for limited contact information required to deliver the resource.

Where you request a free resource:

  • the requested resource may be delivered by email;
  • your information may be recorded in HubSpot;
  • we may retain a record of the request;
  • marketing is optional; and
  • refusing marketing does not prevent you from receiving the resource.

If you separately opt in to marketing, your marketing preference will be recorded.

13. Payments and Stripe

PK Canine may use Stripe to process online payments.

Where Stripe is used, Stripe may process information including:

  • name;
  • email address;
  • billing details;
  • payment details;
  • transaction information;
  • IP address; and
  • fraud-prevention information.

PK Canine does not normally store complete payment card information.

Stripe may process certain information under its own legal responsibilities and privacy terms.

PK Canine may retain transaction records necessary for:

  • accounting;
  • refunds;
  • customer support;
  • fraud prevention;
  • tax;
  • financial records; and
  • dispute resolution.

14. Website Hosting, Email and Infrastructure

PK Canine may use third-party providers to operate its websites, email, online learning and related systems.

These may include:

  • IONOS;
  • Hetzner;
  • Moodle-related services;
  • HubSpot;
  • Stripe;
  • IT and security providers; and
  • other providers necessary to operate our services.

Providers may process personal information only to the extent required to provide their services or where they have their own lawful responsibilities.

15. Spam Prevention and Security Tools

Forms may use anti-spam or security technology such as CAPTCHA or reCAPTCHA.

Where such technology is used, the provider may process technical information such as:

  • IP address;
  • browser information;
  • device information;
  • interaction data; and
  • information used to identify automated or abusive activity.

This processing helps us protect forms, accounts and systems from spam, abuse and automated attacks.

16. Cookies and Similar Technologies

Our website and Moodle platform may use cookies and similar technologies.

Cookies may be used to:

  • maintain login sessions;
  • provide website functionality;
  • protect accounts;
  • remember preferences;
  • support forms;
  • maintain security;
  • measure website performance; and
  • support optional analytics or marketing functionality where enabled.

Some cookies are essential for the operation of the website or Moodle.

Where consent is legally required for non-essential cookies, we will seek consent through the applicable cookie or consent mechanism.

You can also manage cookies through your browser settings.

Blocking essential cookies may prevent parts of our services from operating correctly.

17. Sharing Personal Information

PK Canine does not sell personal information.

We may share information where reasonably necessary with organisations such as:

  • HubSpot;
  • Hetzner;
  • IONOS;
  • Stripe;
  • Moodle-related technical providers;
  • email providers;
  • IT and cybersecurity providers;
  • website providers;
  • accounting providers;
  • insurers;
  • professional advisers;
  • legal advisers;
  • regulators;
  • law-enforcement agencies; and
  • public authorities where legally required.

We aim to provide service providers only with information reasonably necessary for their role.

Depending on the circumstances, an external provider may act as our data processor or as an independent data controller for particular activities.

18. International Transfers

Some service providers may store or process personal information outside the United Kingdom.

Where a transfer of personal information outside the UK is subject to restricted-transfer rules, we will take reasonable steps to ensure an appropriate lawful transfer mechanism is in place.

Depending on the circumstances, this may include:

  • UK adequacy regulations;
  • recognised contractual safeguards;
  • the UK International Data Transfer Agreement;
  • an approved UK Addendum; or
  • another legally permitted transfer mechanism.

19. Data Retention

PK Canine does not intend to retain identifiable personal information for longer than reasonably necessary.

Different information is retained for different periods depending on why it is held.

Moodle accounts and detailed learning records

Normally retained while access is required and for up to 12 months after access ends, unless there is a legitimate or legal reason to retain information for longer.

Course completion and certificate records

May normally be retained for up to six years where reasonably necessary to confirm or verify training and certification.

Client and training records

Relevant records may normally be retained for up to six years following the end of the client relationship where reasonably necessary for contractual, insurance, complaint or legal purposes.

Information which is no longer required may be deleted or anonymised sooner.

Payments, invoices and accounting information

May normally be retained for up to six years, or another period required by applicable tax, accounting or legal requirements.

Enquiry information

General enquiries which do not result in an ongoing client relationship may be deleted when no longer reasonably required.

HubSpot and marketing records

Marketing contact information may be retained while:

  • you remain subscribed;
  • there is an ongoing relationship; or
  • there is another appropriate lawful reason to retain it.

Where you unsubscribe, we may retain a limited suppression record so that we can honour the request.

Free-resource requests

Records of resource delivery may be retained where reasonably necessary to demonstrate delivery, manage requests and maintain appropriate consent records.

Technical and security logs

Technical logs may be retained for different periods depending on:

  • security requirements;
  • operational requirements;
  • backups;
  • investigations; and
  • system administration.

Complaints and legal matters

Retention periods may be extended where information is required in connection with:

  • a complaint;
  • dispute;
  • insurance matter;
  • investigation;
  • legal claim; or
  • regulatory obligation.

20. Security

PK Canine takes reasonable technical and organisational measures to protect personal information.

These may include:

  • HTTPS encrypted connections;
  • password-protected accounts;
  • restricted administrative access;
  • access controls;
  • secure hosting;
  • software updates;
  • security monitoring;
  • backups;
  • anti-spam controls;
  • account permissions; and
  • appropriate administrative procedures.

No internet-based system can be guaranteed to be completely secure.

Users are responsible for keeping their own account passwords confidential.

Please do not share Moodle login credentials with unauthorised persons.

21. Your Data Protection Rights

Depending on the circumstances, UK data protection law may give you rights including:

  • the right to be informed;
  • the right to access personal information;
  • the right to have inaccurate information corrected;
  • the right to request erasure;
  • the right to request restriction of processing;
  • the right to object to certain processing;
  • the right to data portability where applicable;
  • rights relating to certain automated decision-making;
  • the right to withdraw consent where consent is relied upon; and
  • the right to complain to the Information Commissioner's Office.

These rights are not absolute and some rights only apply in particular circumstances.

We may need to verify identity before responding to certain requests.

22. Rights of Younger Learners

A parent or guardian may assist a younger learner in exercising their data protection rights where appropriate.

However, a parent or guardian does not automatically own or control a young person's personal information.

When responding to a request involving a child or young person, PK Canine may consider:

  • the learner's age;
  • understanding;
  • maturity;
  • circumstances;
  • parental responsibility;
  • the nature of the information; and
  • applicable law.

23. Account Closure and Deletion

You may contact PK Canine to request closure of a Moodle account or deletion of personal information.

Account deletion may result in loss of:

  • course access;
  • course progress;
  • assessments;
  • completion information; and
  • certificates stored within the account.

Some information may need to be retained after account closure where necessary for:

  • certificate verification;
  • accounting;
  • tax;
  • legal obligations;
  • insurance;
  • fraud prevention;
  • complaints;
  • disputes; or
  • legal claims.

Where information no longer needs to identify an individual, we may delete or anonymise it where appropriate.

24. Automated Decision-Making

PK Canine does not currently use personal information to make solely automated decisions that produce legal or similarly significant effects on individuals.

Moodle may automatically calculate quiz scores, completion conditions or course progress.

These routine educational functions are used to administer courses and are not intended to make legal or similarly significant automated decisions about learners.

25. Special Category Information

PK Canine does not normally require special category personal information to provide standard training or online learning services.

Please avoid providing sensitive personal information unless it is relevant and reasonably necessary.

If we need to process special category information, we will identify an appropriate lawful basis and additional legal condition where required.

26. Links to Other Websites and Platforms

Our websites, courses, emails and social media may contain links to external websites or platforms.

PK Canine is not responsible for the privacy practices of independent third-party websites.

You should review the privacy information provided by the relevant organisation when using an external service.

27. Complaints

If you have concerns about how PK Canine handles personal information, please contact us so that we have the opportunity to investigate.

Privacy enquiries:
enquiries@pkcanine.co.uk

You also have the right to complain to the Information Commissioner's Office (ICO), the UK's independent data protection regulator.

We may update this Privacy Policy where necessary to reflect:

  • changes to our services;
  • changes to Moodle;
  • changes to HubSpot;
  • changes to our website;
  • changes to service providers;
  • new courses;
  • new forms or lead magnets;
  • changes to our registration arrangements;
  • changes in data-processing activities; or
  • legal or regulatory developments.

Where appropriate, we will update the version number and last-updated date.

Where a change requires new consent or another specific action, we will take appropriate steps.
